User Privacy Policy
This privacy policy ("Policy") discloses the practices and policies adopted by HEALTH AND GLOW PRIVATE LIMITED for collecting, storing, retrieving or using personal data and sensitive personal data or information it may receive from its users. The Policy seeks to comply with the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011.
HEALTH AND GLOW PRIVATE LIMITED reserves the right to modify or review the provisions in this Policy without prior notice. Therefore, Users are requested to periodically visit the app and/or website and review the policy.
1. Definitions
"Applicable Law" means all applicable statutes, acts of Indian legislature, ordinances, rules, bye-laws, regulations, notifications, circulars, guidelines, policies, directions, directives and orders of any government, statutory authority, regulatory authority, tribunal, board or court in India.
"Face Data" means any image, photograph, or visual representation of a User's face that is voluntarily uploaded or captured through the app solely for the purpose of creating or updating a User profile photograph. Face Data does not include biometric identifiers, facial geometry, facial recognition data, or any data derived from facial scanning or analysis.
"Personal Information" shall mean information disclosed by or obtained from any User and includes name, age, occupation, email, residential address, telephone number, payment processing details and any other personal details capable of identifying such a person.
"Sensitive Personal Information" shall mean the following information (excluding information that is freely available in public domain):
- Account password
- Physical, physiological or mental health condition
- Sexual orientation; medical records and history
- Financial information such as bank account or credit/debit card details or other payment instruction details
"User" means any Person who visits or uses the app and/or website or avails of the services of the app and/or website.
2. Collection of Information
A User may be required to reveal Personal Information, including Sensitive Personal Information, while browsing through the app and/or website or for availing services.
Prior to furnishing Personal Information, a User must grant consent to HEALTH AND GLOW PRIVATE LIMITED for using the Personal Information. If the User does not wish to provide such Personal Information, the User must not proceed with using the app and/or website.
HEALTH AND GLOW PRIVATE LIMITED will collect Personal Information only for a lawful purpose connected with a function or activity of the company for which such information is reasonably considered necessary.
HEALTH AND GLOW PRIVATE LIMITED will not be responsible for the correctness or completeness of the Personal Information provided by the User, or any consequences arising in relation to incorrect or incomplete information.
While browsing, the server may automatically record some General Information about your visit such as date and time, IP address, and browser type. Such General Information is not Personal Information for the purpose of this Policy and may be used for statistical analysis, traffic tracking, and marketing purposes.
The app may also collect Face Data in the form of a profile photograph, which the User may voluntarily upload from their device gallery or capture using their device camera. Providing a profile photograph is entirely optional and is solely for the purpose of personalising the User's account profile. No facial scanning, biometric processing, or facial recognition technology is applied to any such image.
3. Use of Personal Information
Personal Information disclosed to HEALTH AND GLOW PRIVATE LIMITED by a User will be used for one or more of the following purposes:
- To assist in creating content that is relevant to the User
- To maintain a database of all the Personal Information collected from the User
- To evaluate and administer the app and/or website and resolve any problems that may arise with usage
3A. Face Data — Collection, Use, Disclosure & Retention
What Face Data does the app collect?
The app collects Face Data solely in the form of a profile photograph voluntarily provided by the User. The User may either upload a photo from their device's photo gallery or capture a new photo using their device camera. No other face-related data — including facial geometry, biometric identifiers, or facial recognition templates — is collected, generated, or processed at any point.
How is Face Data used?
Face Data collected through the app is used exclusively for the following purpose:
- To display the User's profile photograph within their account profile on the Health & Glow app and/or website.
Face Data is not used for any of the following purposes:
- Facial recognition or identification
- Biometric authentication
- Advertising, marketing, or profiling
- Training of machine learning or artificial intelligence models
- Any purpose beyond displaying the User's profile photograph
Will Face Data be shared with any third parties?
Face Data will not be sold, licensed, or shared with any third party for commercial or marketing purposes. Face Data may only be shared with authorised technology or cloud service providers engaged by HEALTH AND GLOW PRIVATE LIMITED strictly for the purpose of hosting and displaying the profile photograph within the app. Such service providers are contractually obligated to process Face Data solely as instructed and are prohibited from using it for any independent purpose.
Where is Face Data stored?
Face Data is stored on secured servers maintained by or on behalf of HEALTH AND GLOW PRIVATE LIMITED. All reasonable technical and organisational security measures are applied to protect Face Data from unauthorised access, disclosure, or misuse.
How long is Face Data retained?
Face Data will be retained for as long as the User maintains an active account on the Health & Glow app and/or website. Upon deletion of the User's account, or upon the User's written request for removal of their profile photograph, the Face Data will be permanently deleted from our systems within a reasonable period, not exceeding 30 days from the date of such request or account deletion.
Users may update or remove their profile photograph at any time through the account settings within the app.
4. Cookies
When a User visits the app and/or website, one or more cookies shall be sent to the computer or device being used. Cookies are used to improve the quality of the services provided by HEALTH AND GLOW PRIVATE LIMITED, including for storing User preferences, improving search results and tracking User trends.
Users will always have the option of disabling cookies via their browser preferences. However, if cookies are disabled, some parts of the app and/or website may not function as effectively.
5. Information Sharing and Disclosure
Only Persons authorized by HEALTH AND GLOW PRIVATE LIMITED shall have access to Personal Information and Sensitive Personal Information. User grants consent for sharing Personal Information with persons who are associated with HEALTH AND GLOW PRIVATE LIMITED.
Face Data (profile photograph) is not shared with any unauthorised third party and is not used for any purpose other than displaying the User's profile within the app. Refer to Section 3A for complete details on Face Data handling.
HEALTH AND GLOW PRIVATE LIMITED reserves the right to disclose any Personal Information or Sensitive Personal Information that may be required to be disclosed under applicable law, without prior notice or consent of the User.
6. Disclosure to a Third Party
HEALTH AND GLOW PRIVATE LIMITED shall obtain prior permission from the User before transferring information to any third party, unless such disclosure is necessary for compliance of a legal obligation or is requested by a government agency.
HEALTH AND GLOW PRIVATE LIMITED may transfer Personal Information to any company or person located in India or any other country only if it is necessary for the performance of a lawful contract. HEALTH AND GLOW PRIVATE LIMITED cannot guarantee that such parties will keep the information confidential and will not be liable for any loss of confidentiality attributable to such third parties.
7. Security
HEALTH AND GLOW PRIVATE LIMITED has taken all reasonable measures and precautions to keep the Personal Information and Sensitive Personal Information safe and secure and to prevent any unauthorized access to or misuse of such information.
HEALTH AND GLOW PRIVATE LIMITED shall not be liable to any User for any loss, damage (whether direct, indirect, consequential or incidental) or harm caused due to the unauthorized access or misuse of Personal Information by any third party beyond the control of HEALTH AND GLOW PRIVATE LIMITED.
8. Linking to Other Websites
HEALTH AND GLOW PRIVATE LIMITED is not responsible for the privacy practices or the content of any other websites for which links may be provided on the app and/or website. By clicking on a link, you may no longer be on the app and/or website and the privacy policy of such other website shall apply. HEALTH AND GLOW PRIVATE LIMITED encourages Users to read the posted privacy statement of any other website whenever interacting with it.
